Terms of service
Last Updated: July 15, 2026
Welcome to Heart Art. These Terms of Service (“Terms”) apply to your use of our website, online shop, Mail Club subscription, products, services, and any related content provided by Heart Art (“Heart Art,” “we,” “our,” or “us”).
By visiting our website, creating an account, placing an order, subscribing to our Mail Club, or using our services, you agree to these Terms. Please read them carefully before making a purchase.
1. About Heart Art
Heart Art is a monthly art mail club centered around artist discovery, collectible art, stationery, and creative inspiration. Each volume may feature collectible art cards, stationery items, creative prompts, paper goods, surprise extras, and artwork created by Featured Artists and/or the Heart Art team.
2. Use of Our Website
You agree to use our website and services for lawful purposes only. You may not use our website in a way that could harm Heart Art, interfere with the website’s operation, misuse our content, or violate the rights of others.
We reserve the right to refuse service, cancel orders, suspend accounts, or restrict access to our website if we believe these Terms have been violated.
3. Products and Availability
We do our best to describe and display our products accurately. However, colors, sizes, materials, packaging, and product details may vary slightly from what appears on screen.
Many Heart Art products may be limited-edition, small-batch, seasonal, or available only while supplies last. We cannot guarantee that any specific product, volume, artist collaboration, or design will remain available.
We reserve the right to modify, discontinue, limit quantities, or cancel products at any time.
4. Mail Club Subscriptions
If you purchase a Heart Art Mail Club subscription, you agree to be charged on a recurring basis according to the subscription plan shown at checkout.
Your subscription will automatically renew until you cancel it. The price, billing frequency, renewal date, and included products will be shown before you complete your purchase.
By subscribing, you authorize Heart Art and our payment providers to charge your payment method for recurring subscription fees, taxes, shipping, and any other applicable charges.
5. Subscription Billing and Renewal
Subscription billing occurs according to the schedule shown at checkout and/or in your account. Your payment method will be charged automatically unless you cancel before the next billing date.
If your payment method fails, we may attempt to process the payment again. If payment cannot be completed, your subscription may be paused, delayed, or canceled.
Prices, shipping fees, taxes, and subscription terms may change in the future. If we make material changes to your subscription terms, we will provide notice as required by applicable law.
6. Subscription Cancellation
You may cancel your subscription through your customer account, subscription management page, or by contacting us at support@heartartclub.com.
Cancellation requests must be submitted before your next billing date to avoid being charged for the next subscription period. If your subscription has already renewed or your order has already begun processing, cancellation may apply to future billing cycles only.
Canceling a subscription does not automatically cancel an order that has already been processed, packed, shipped, or fulfilled.
7. One-Time Purchases
We may offer one-time purchases, limited releases, past volumes, stationery items, art goods, or other products separate from the Mail Club subscription.
One-time purchases are charged at the time of checkout and are subject to our Shipping Policy and Returns, Refunds & Cancellation Policy.
8. Preorders and Launch Orders
Some Heart Art products or volumes may be sold as preorders or launch orders before they are ready to ship.
If a product is a preorder, the estimated shipping timeline will be listed on the product page or checkout page. Shipping dates are estimates and may change due to production, artist collaboration timelines, printing, packaging, supply chain delays, or other circumstances.
If there is a significant delay, we will make reasonable efforts to notify you.
9. Shipping
Shipping options, costs, and estimated delivery timelines will be shown at checkout or on our Shipping Policy page.
Please make sure your shipping address is accurate before placing your order. Heart Art is not responsible for delays, missing packages, or additional costs caused by an incorrect or incomplete address provided by the customer.
Once an order is handed to the shipping carrier, delivery timing may be affected by the carrier, weather, holidays, customs, or other circumstances outside our control.
For more details, please review our Shipping Policy.
10. Returns, Refunds, and Damaged Orders
Because Heart Art products may include limited-edition art, paper goods, stationery, and small-batch items, returns and refunds may be limited.
Our return, refund, replacement, and cancellation policies are described in our Returns, Refunds & Cancellation Policy.
If your order arrives damaged or incorrect, please contact us at [insert support email] within [number] days of delivery with your order number and photos of the issue. We will review the request and do our best to help.
11. Taxes
Applicable taxes may be calculated and charged at checkout based on your shipping address and applicable laws.
You are responsible for any taxes, customs duties, import fees, or other charges that may apply to your order.
12. Promotions and Discount Codes
We may offer promotions, discount codes, referral offers, or special pricing from time to time.
Promotions may be subject to additional terms, expiration dates, product exclusions, quantity limits, or other restrictions. Discount codes cannot be applied retroactively unless stated otherwise.
We reserve the right to modify, cancel, or refuse promotions if misuse, fraud, or error is suspected.
13. Artist Collaborations and Featured Artwork
Heart Art works with Featured Artists to share and celebrate their artwork through our Mail Club and related products.
All artist artwork remains the property of the respective artist unless otherwise agreed in writing. Purchasing a Heart Art product does not give you ownership of the underlying artwork, copyright, commercial rights, reproduction rights, or permission to copy, resell, modify, or use the artwork for commercial purposes.
You may enjoy, collect, display, and personally use the physical items you purchase, but you may not reproduce, scan, print, distribute, or sell copies of the artwork without permission from the rights holder.
14. Intellectual Property
All content on the Heart Art website, including text, graphics, logos, branding, product designs, photography, illustrations, layouts, and other materials, is owned by Heart Art, our Featured Artists, or our licensors and is protected by intellectual property laws.
You may not copy, reproduce, distribute, modify, sell, or use our content for commercial purposes without written permission.
15. Customer Content, Reviews, and Submissions
If you submit reviews, photos, comments, survey responses, artist inquiries, or other content to Heart Art, you agree that the information you provide is accurate and does not violate the rights of others.
By submitting content to us, you allow Heart Art to review, respond to, and use that content for customer service, business operations, testimonials, marketing, or community purposes, unless otherwise restricted by applicable law or agreed in writing.
We reserve the right to remove or decline to publish content that is inappropriate, misleading, offensive, unlawful, or unrelated to Heart Art.

19. Errors and Inaccuracies

We reserve the right to correct errors, update information, cancel orders, or refuse transactions if information on our website is inaccurate, even after an order has been placed.
If your order is canceled after payment has been processed, we will issue a refund for the canceled portion of the order.
20. Limitation of Liability
To the fullest extent permitted by law, Heart Art is not responsible for indirect, incidental, special, consequential, or punitive damages arising from your use of our website, products, services, or inability to access them.
Our total liability for any claim related to your order or use of our services will not exceed the amount you paid to Heart Art for the product or service giving rise to the claim.
Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.
21. No Warranties
Our website, products, and services are provided “as is” and “as available,” unless otherwise stated.
We do not guarantee that our website will always be uninterrupted, error-free, secure, or available. We also do not guarantee that every product will meet your personal expectations, although we do our best to create thoughtful and high-quality items.
22. Indemnification
You agree to indemnify and hold Heart Art harmless from any claims, damages, losses, liabilities, costs, or expenses arising from your violation of these Terms, misuse of our website or products, or violation of any rights of another person or entity.
